my husband and i was wondering about workers comp?
my husband hurt his index finger at work they had to do surgery on it and his employer had him come to work and sit in the office so he could get his pay but someone told him he could settle his case so we called workers comp and they said yes can he get a cash award ive never been down this road before and i was just wondering
yes, he COULD get a cash reward, but the amount of the reward will be based on how "disabled" he is by his injury. They rate the disability on a scale of 1-100, with 1% disability being "not very disabled" to 100% disability being "completely disabled". My husband almost lost his foot at work and has trouble walking to this day. He was only deemed 47% disabled and collected about 40k. But he was out of work for 2 years recovering and he makes over 100k per year, so you do the math.
In any case, if you can get a work comp atty to take your case they usually will not charge you unless you collect and then they will charge you a fixed percentage of your cash award. If your husband lost a lot of money being away from work then you should consider hiring an atty to collect. Also, if he will require additional surgery in the future you will want to make sure that the settlement includes paying the cost for all future treatment. If you choose to take a lump sum settlement you may have to sign an agreement that they will not cover future expenses. Usually you will get a check every few weeks for several years instead of a lump sum.
